This website is operated by Majestic Living Designs. Throughout this website and these Terms of Service, the terms “we,” “us,” and “our” refer to Majestic Living Designs.

Majestic Living Designs provides this website, including all information, tools, products, and services available through it, subject to your acceptance of the terms, conditions, policies, and notices stated herein.

By visiting our website, purchasing or claiming an item, participating in a live sale or event, or interacting with us through our Facebook groups, posts, message threads, or other associated platforms, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”).

These Terms apply to all users of the Service, including browsers, customers, purchasers, vendors, merchants, and individuals who submit or contribute content.

Claiming an item during a live sale, post, event, or other sales opportunity constitutes a binding agreement to purchase that item in accordance with these Terms.

Please read these Terms carefully before accessing or using our website or participating in our sales or communities. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all provisions contained in these Terms, you may not access or use the Service.

Any new features, tools, products, or services added to the Service will also be subject to these Terms.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to offer and sell our products and services.

SECTION 1 – ONLINE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence. If you permit a minor child or dependent to access or use the Service, you accept responsibility for their use of the Service and agree to supervise their activity.

You may not use our website, products, services, sales platforms, or communities for any unlawful, fraudulent, abusive, or unauthorized purpose. You must comply with all applicable local, state, federal, and international laws and regulations, including intellectual-property and copyright laws.

You may not upload, transmit, distribute, or introduce viruses, malicious code, harmful software, or any other technology intended to damage, disrupt, interfere with, or gain unauthorized access to the Service or any related system, account, or network.

A breach or violation of these Terms may result in the restriction, suspension, or termination of your access to the Service and may also result in removal or banning from our website, Facebook groups, live events, sales platforms, or other communities operated by Majestic Living Designs.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse, limit, suspend, or discontinue service to any person, order, account, or transaction at our discretion, except where prohibited by applicable law.

You understand that information submitted through the Service, other than payment card information processed through authorized payment providers, may be transmitted through various networks and modified as technically necessary to operate across devices, systems, or platforms. Payment information is processed through secure payment systems provided by Shopify or another authorized payment provider.

You may not reproduce, duplicate, copy, sell, resell, distribute, or otherwise exploit any portion of the Service, access to the Service, or content made available through the Service without prior written permission from Majestic Living Designs.

Section headings are provided for convenience only and do not affect the meaning or interpretation of these Terms.

SECTION 3 – ACCURACY OF INFORMATION

We make reasonable efforts to ensure that information provided through the Service is accurate, complete, and current. However, information may occasionally contain errors, omissions, or outdated material and is provided for general informational purposes.

Historical information may be made available through the Service for reference and may not reflect current products, prices, policies, availability, or business practices.

We reserve the right to correct, update, or modify information made available through the Service at any time, except where notice or another action is required by applicable law.

SECTION 4 – MODIFICATIONS TO SERVICE AND PRICES

Product prices, availability, descriptions, promotions, and other information offered through the Service may be changed or updated at any time without prior notice.

We reserve the right to modify, suspend, limit, or discontinue the Service, or any feature, product, or portion of the Service, at any time, subject to applicable law.

Majestic Living Designs will not be liable to you or any third party for any lawful modification, price change, suspension, limitation, or discontinuation of the Service, except to the extent liability cannot be excluded under applicable law.

SECTION 5 – PRODUCTS OR SERVICES

Certain products or services may be available exclusively through our website, Facebook groups, live sales, posts, events, or other associated sales platforms. Products may be offered in limited quantities and are subject to availability. Returns, exchanges, refunds, or other remedies, if available, are governed by our Refund Policy and applicable law.

We make reasonable efforts to display and describe our products accurately, including their colors, appearance, measurements, and other characteristics. However, colors and visual details may vary depending on lighting, photography, video quality, screen settings, and the device used to view the product.

We reserve the right to limit or refuse sales to any person, account, household, geographic region, or jurisdiction, except where prohibited by applicable law. We may also limit the quantities of any products or services offered.

Product descriptions, pricing, availability, and other product information may be corrected or updated at any time. We reserve the right to discontinue any product or service, subject to any obligations relating to orders that we have already accepted.

SECTION 6 – BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse, limit, correct, or cancel any order or transaction at our discretion, including orders affected by suspected fraud, unauthorized activity, pricing or inventory errors, inaccurate customer information, or violations of these Terms.

We may limit or cancel quantities purchased by the same person, household, customer account, payment method, billing address, shipping address, or other information reasonably indicating that orders are related.

If we modify or cancel an order after payment has been received, we will make reasonable efforts to notify you using the contact information provided and will issue any refund or adjustment that is due.

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all transactions. You are responsible for promptly updating your information, including your email address and shipping address, so that we can complete transactions and contact you when necessary.

SECTION 7 – INVOICES AND CLAIMS

All sales and claims are final except as otherwise provided in our Refund Policy or required by applicable law. Claiming an item through our website, Facebook groups, live sales, events, posts, or other associated platforms constitutes a binding agreement to purchase that item in accordance with these Terms.

Invoices are typically issued following our Friday Facebook Live sales and other sales events. Unless a Build-A-Box arrangement has been approved, invoices are due in full upon receipt.

With approval from Majestic Living Designs, customers may participate in our Build-A-Box program, which allows claimed or purchased items from multiple sales events to be combined into a future shipment. Customers may add items to an open invoice and make payments toward the outstanding balance.

By choosing to participate in Build-A-Box, the customer requests and consents to shipment being delayed until the customer requests shipment, the total invoice value reaches approximately $500, or Majestic Living Designs closes the Build-A-Box for operational or shipping purposes, whichever occurs first.

When shipment is requested, the approximately $500 limit is reached, or the Build-A-Box is closed, the remaining balance, including applicable shipping charges, becomes due. No package will be shipped until the invoice and shipping charges are paid in full. We will make reasonable efforts to notify the customer if we determine that a Build-A-Box must be closed.

An invoice that remains unpaid for more than three (3) days without payment or communication may be canceled, and the associated items may be returned to inventory at our discretion. Any payment previously received will be handled in accordance with our Refund Policy, including any clearly disclosed and legally permitted holding or restocking fee.

If an invoice, Build-A-Box, or order remains unpaid and we receive no communication from the customer for thirty (30) days, it may be considered abandoned. The customer’s claims to the items may be forfeited, and the items may be returned to inventory and resold after reasonable efforts have been made to contact the customer. Any payment previously received will be handled in accordance with our Refund Policy and applicable law.

If a customer voluntarily leaves or is removed from our Facebook groups or other communities because of rule violations, all outstanding invoices become immediately due and payable unless Majestic Living Designs elects to cancel an unfulfilled claim. Leaving or being removed from a community does not cancel payment obligations already incurred under these Terms.

Majestic Living Designs Administrators and Moderators may assist with enforcing community rules, managing sales events, resolving claim issues, and maintaining community standards. Actions taken in good faith by an Administrator or Moderator for these purposes are authorized by Majestic Living Designs.

SECTION 7A – PAYMENT DISPUTES AND CHARGEBACKS

Customers agree to contact Majestic Living Designs directly to resolve any issues before initiating a payment dispute or chargeback.

Filing a fraudulent chargeback without first attempting to resolve the issue may result in immediate removal from our website, Facebook groups, and future purchasing opportunities.

Majestic Living Designs reserves the right to provide invoices, payment history, communications, screenshots, and claim records to payment processors or financial institutions to resolve disputes.

SECTION 7B – CLAIM RECORDS

Majestic Living Designs maintains records of item claims, invoices, payments, and communications related to purchases made through our website, Facebook groups, and live events. These records may include screenshots, system logs, invoices, and payment confirmations and may be used to verify purchases and resolve disputes.

SECTION 7C – CLAIM COMMITMENT

By claiming an item during a live sale, post, or event, the customer acknowledges that they are committing to purchase that item. Claims should only be made when the customer intends to complete payment according to our invoice and Build-A-Box policies. Claiming items without the intention of completing payment, repeatedly abandoning invoices, or failing to communicate regarding outstanding balances may result in restriction from future claims or removal from our sales platforms.

SECTION 7D – CLAIM LIMITATIONS

Majestic Living Designs reserves the right to limit or restrict the ability of customers to claim additional items if they have outstanding unpaid invoices or repeated violations of our invoice policies.

SECTION 7E - COMMUNITY CONDUCT, BLOCKING, AND HOSTILITY

Participation in any Majestic Living Designs website, Facebook group, live event, sale, post, message thread, or associated platform requires respectful conduct toward our Administrators, Moderators, customers, and community members.

Members and customers may not block or restrict any Majestic Living Designs Administrator or Moderator while participating in our groups, sales, events, or associated platforms. Blocking or restricting an Administrator or Moderator prevents official communication and may interfere with moderation, invoicing, sales administration, dispute resolution, or enforcement of these Terms.

Blocking or restricting an Administrator or Moderator is grounds for immediate removal from our groups, restriction from future participation, and refusal of future service.

Rude, hostile, threatening, harassing, retaliatory, abusive, intimidating, bullying, or gaslighting behavior toward any Administrator, Moderator, customer, or community member is prohibited. This includes directing or encouraging others to engage in such conduct.

Conduct occurring on personal pages or outside Majestic Living Designs platforms may be considered when it is directly connected to Majestic Living Designs, group participation, sales activity, transactions, live events, official communications, or interactions arising from participation in our communities.

Majestic Living Designs reserves the right to determine whether conduct violates these Terms based on the information reasonably available to us. Violations may result in a warning, restriction, suspension, immediate removal, permanent banning, cancellation of unfulfilled claims, or refusal of future service. Majestic Living Designs is not required to issue a warning before taking action.

Removal, restriction, or banning from any group, event, or platform does not cancel outstanding invoices, payment responsibilities, or any other obligations previously incurred under these Terms.

Nothing in this section prohibits honest reviews, truthful statements regarding personal experiences, good-faith complaints, or lawful reports. However, threats, harassment, abuse, disclosure of private or confidential information, impersonation, and knowingly false statements remain prohibited.

SECTION 8 – OPTIONAL TOOLS

We may provide access to third-party tools, services, applications, or integrations that we do not own, operate, monitor, or control.

These third-party tools are provided for convenience and may be subject to separate terms, conditions, and privacy policies established by their providers. Your use of any third-party tool is at your own discretion and risk.

Majestic Living Designs is not responsible for any loss, damage, interruption, or other issue arising from the use of a third-party tool, except to the extent such responsibility cannot be excluded under applicable law.

SECTION 9 – THIRD-PARTY LINKS

The Service may contain links to third-party websites, resources, products, or services that are not owned, operated, or controlled by Majestic Living Designs.

We do not guarantee and are not responsible for the content, accuracy, availability, security, privacy practices, products, services, or business practices of any third party.

You should review the applicable terms, policies, and practices of a third party before providing personal information or completing a transaction. Questions, complaints, claims, or concerns regarding third-party products or services should be directed to the applicable third party.

SECTION 10 – USER COMMENTS AND SUBMISSIONS

When you voluntarily submit comments, photographs, videos, testimonials, suggestions, ideas, or other content to Majestic Living Designs specifically for publication, promotion, or consideration for sharing, you grant Majestic Living Designs a non-exclusive, royalty-free license to use, reproduce, edit, publish, display, and distribute that content in connection with our business, marketing, social-media platforms, and promotional activities.

You retain ownership of your original content. You represent that you own or have permission to submit the content and that our authorized use of it will not violate another person’s rights.

This license does not automatically apply to private customer-service communications, payment information, order information, honest reviews, or good-faith complaints unless you separately authorize their publication.

We reserve the right, but are not obligated, to remove or decline to publish content that is unlawful, threatening, abusive, defamatory, deceptive, infringing, obscene, or otherwise violates these Terms.

SECTION 11 – PERSONAL INFORMATION

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Certain information may also be processed by third-party providers that assist with payment processing, website hosting, order fulfillment, shipping, communications, analytics, or other business operations. Those providers may process information in accordance with their own terms and privacy policies.

SECTION 12 – ERRORS AND OMISSIONS

Information made available through the Service may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, processing times, or other information.

We reserve the right to correct errors, inaccuracies, or omissions and to update information at any time without prior notice, subject to applicable law.

If an error affects an order before fulfillment, we may correct the order, contact you for instructions, or cancel the affected portion of the order. If payment has already been received for an order or item that we cancel, we will issue the refund or adjustment that is due.

SECTION 13 – PROHIBITED USES

You may not use the Service, our website, sales platforms, communities, content, or associated systems:

  1. For any unlawful, fraudulent, deceptive, abusive, or unauthorized purpose;
  2. To violate any applicable law, regulation, intellectual-property right, privacy right, or other legal right;
  3. To harass, threaten, intimidate, impersonate, defame, exploit, or harm another person;
  4. To submit false, misleading, or fraudulent information;
  5. To upload or transmit viruses, malicious code, or other harmful technology;
  6. To interfere with, disrupt, bypass, test, or gain unauthorized access to any account, system, network, security feature, or portion of the Service;
  7. To collect, scrape, track, or use information about other users without authorization;
  8. To send spam, phishing messages, unsolicited promotions, or other deceptive communications; or
  9. To reproduce, copy, distribute, resell, or commercially exploit the Service or its content without our prior written permission.

To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that access to the Service will always be uninterrupted, timely, secure, or free from errors.

Except for any express product description, written warranty, remedy stated in our Refund Policy, or right that cannot legally be excluded, Majestic Living Designs disclaims all warranties, representations, and conditions, whether express, implied, or statutory, to the fullest extent permitted by law.

Nothing in these Terms excludes or limits any warranty, remedy, or consumer right that cannot legally be waived or excluded.

SECTION 15 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Majestic Living Designs and its owners, employees, representatives, Administrators, Moderators, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the use of, or inability to use, the Service.

This limitation includes, where legally permitted, losses resulting from interrupted access, lost data, unauthorized third-party activity, third-party services, or reliance on information made available through the Service.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under applicable law.

SECTION 16 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Majestic Living Designs and its owners, employees, representatives, Administrators, Moderators, contractors, service providers, and affiliates from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

  1. Your unlawful or unauthorized use of the Service;
  2. Your violation of these Terms;
  3. Content you submit that violates another person’s rights; or
  4. Your violation of any applicable law or third-party right.

This obligation does not apply to the extent a claim results from the unlawful conduct or legally established wrongdoing of Majestic Living Designs.

SECTION 17 – SEVERABILITY

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent legally permitted or, when necessary, severed from these Terms.

The remaining provisions will continue in full force and effect.

SECTION 18 – TERMINATION

These Terms remain effective while you access or use the Service or have outstanding obligations to Majestic Living Designs.

You may discontinue your use of the Service at any time. We may restrict, suspend, or terminate your access to all or any portion of the Service if you violate these Terms, engage in conduct harmful to Majestic Living Designs or its communities, or when termination is otherwise reasonably necessary to protect our business, customers, systems, or legal rights.

Termination or loss of access does not cancel any outstanding invoice, payment responsibility, claim commitment, or other obligation incurred before termination.

Provisions that by their nature should continue after termination—including payment obligations, content licenses, limitations of liability, indemnification, governing law, and dispute-related provisions—will remain effective.

SECTION 19 – GOVERNING LAW

These Terms and any dispute arising from or relating to the Service will be governed by and interpreted in accordance with the laws of the State of South Carolina, United States, without regard to conflict-of-law principles.

This provision does not deprive a consumer of any protection that cannot legally be waived under otherwise applicable law.

SECTION 20 – CHANGES TO TERMS

We reserve the right to update, modify, or replace these Terms by posting the revised version through our website. The revised Terms will identify the date on which they were last updated.

Unless otherwise stated, changes become effective when posted and apply to subsequent access to or use of the Service. Your continued use of the Service after revised Terms become effective constitutes acceptance of those changes.

Changes will not retroactively alter the terms governing a completed transaction or eliminate rights or obligations that arose before the change, except where required by law or agreed to by the affected parties.
